Terms and Conditions

• Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
• Entry is only open to Australian residents aged 18 years or over who agree to accept the prize on the terms outlined herein if selected as a winner.
• Employees (and their immediate families) of the Promoter, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
• Entries into the promotion open on 15/06/2023 11.59 pm AWST and close as soon entries have been collected.
• To enter, individuals must visit. https://www.powerdriveroofing.com.au/services/roof-replacement-perth/ fill out the requested details, including their first and last name, contact phone number, residential and email address.
• Have a quotation booked for a full roof restoration or works to the value of no less than $4500.00 agree to these Terms and Conditions and the Promoter’s Privacy Policy acceptance of the quotation and a 6.5% will be considered as your entry form provided non-refundable deposit is paid within the Promotional Period.
• The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence).
• If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
• The draw will take place at a location to be advised and will be live streamed on our Facebook page https://www.facebook.com/powerdriveroofing01/
• once 50 full roof restoration contracts have been entered into, including a non-refundable deposit of 10% of the total contract and meets the guidelines set out in our terms and conditions.
• The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winner will be notified by email and phone within two (2) business days of the draw, and their names will be published on our Facebook page.
• The Promoter’s decision is final and no correspondence will be entered into.
• The first valid entry drawn will win $10,000 cash
• The next three (3) valid entries drawn will each win a free whirlybird with the install on their new Powerdrive Roofing Roof. Or $250.00 cash

The following inclusions and conditions apply to the Major Prize:

• The prize is AU$10,000 cash
• To be eligible for the prize you must have had your roof already restored by Powerdrive Roofing or be under contract with Powerdrive Roofing for a complete roof restoration and have your 10% non-refundable deposit paid. Only quotes obtained after 15/06/2023 will be eligible.
• If you are under contract but yet to have your roof restoration completed you will sign for the cash prize to be used for the roof restoration on your residential property and any left over funds would be paid out to the winner upon completion of the roof restoration.
• In the event that agreement cannot be reached between the Promoter and the winner (in relation to the exact material or installation and delivery timelines), despite reasonable efforts of the Promoter, or if the winner is unable to or refuses to have or accept the materials, installation and/or delivery at their property for any reason or refuses to agree to any condition of accepting the prize, the Promoter reserves the right, in its absolute discretion, to invalidate such a winner.
• As a condition of accepting the Major Prize, the winner consents and agrees (and agrees to procure any co-owners(s) of the property consent and agreement):
• To allow access to the Promoter’s representatives and contractors to their property prior to the commencement of their roof restoration (where applicable) or renovation, during the roof restoration or renovation and for one (1) month after the property renovation (and completion of the Powerdrive Roofing Roof) is completed;
• For the Promoter’s representatives and contractors to undertake the necessary delivery/installation of the roofing material on the winner’s property;
• For the Promoter’s representatives to take photographs and video of the winner’s property during each visit, as well as the winner in the property (“Property Photos/Videos”), and that all intellectual property rights (including copyright) in such Property Photos/Videos vest in and remain with the Promoter;
• To participate in reasonable promotional activities, including photography/video sessions, interviews and appearances organised by the Promoter;
• To the Promoter using the winner’s property, name, likeness, image and/or voice (including as depicted in Property Photos/Videos, other photographs, film and/or recordings) and a story about the winner and how the prize was used in the winner’s property, in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and Powerdrive Roofing.
• The Promoter has all editorial control over material featuring the winner and/or the winner’s property, and any such material will not be subject to the winner’s prior approval; and
• In the case that the winner’s property is a semi-detached home, to obtain the consent of adjoining owners to the extent necessary to permit the roof installation of for the claiming of the prize to proceed.
• Total prize pool value is AU$10,750.
• A draw for any unclaimed prizes may take place 14 days after the original draw at the same time and place as the original draw, subject to any directions from a regulatory authority. Winner, if any, will be notified by email and phone within two (2) business days of the draw and their names will be published on https://www.facebook.com/powerdriveroofing01/
• Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
• If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. The Promoter may in it’s absolute discretion not a certain a particular entry, may disqualify an entry or cancel the entire promotion at any time without giving reasons and without liability to any entrants.
• Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
• Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
• Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of or taking of a prize.
• As a condition of accepting a prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
• The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia.
